1) Purpose and Scope

These Terms & Conditions (the “Terms”) govern your access to and use of MuslimSurfer websites, software, mobile applications, dashboards, and any other related products or services provided by MSURFER OÜ (“MuslimSurfer,” “we,” “us,” or “our”) (collectively, the “Services”). By using the Services, you (“you,” the “User”) agree to be bound by these Terms. If you do not agree, do not use the Services.

These Terms apply whether or not you create an account. Other policies referenced here—such as our Privacy Policy, Cookies Policy, App Privacy disclosures, and platform-specific EULAs—form part of these Terms.

2) Changes to These Terms

We may revise these Terms from time to time. When we do, we will post the updated version on our website and change the “Last updated” date above. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

3) Legal Notices & Applicable Law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules, and subject to mandatory protections under EU consumer law where applicable. Unless consumer law provides you a different forum, disputes may be brought before the competent courts of Tallinn, Estonia. The Services may be subject to additional local laws in the country where you reside or use the Services.

4) The Services in Brief

MuslimSurfer provides tools that enable parents and legal guardians to configure digital safeguards on their children’s devices (e.g., content/category blocking, time limits, location features where available, emergency signals, and supervision tools). The Services typically involve:

  • a Guardian Dashboard (web and/or app) used by parents/legal guardians; and
  • a Child App installed on the child’s device (with appropriate consent and notices) that enables monitoring and protective features.

We may add, change, or remove features over time. Feature availability can vary by region, platform, OS version, device model, and subscription tier.

5) Platform Terms & EULAs

If you download the apps from an app store, you also agree to the store’s terms and any standard end-user license agreement (EULA) provided by that store in addition to these Terms (for example, Apple Media Services Terms including Apple’s Standard EULA; Google Play Terms of Service). Where a store EULA conflicts with these Terms, the store EULA may prevail for the scope of the conflict required by the platform.

6) License to Use the Apps

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to download and run the MuslimSurfer apps on devices you own or control and to access the Services solely for lawful, family-supervision purposes. You may not:

  1. sell, rent, lease, sublicense, assign, or transfer the apps or your account;
  2. copy, modify, adapt, translate, or create derivative works of the Services;
  3. reverse-engineer, decompile, or attempt to extract source code except where permitted by law;
  4. maintain more than one personal account per individual guardian;
  5. use the Services in any unlawful way or in violation of these Terms.

7) Accounts, Identity & Security

You must provide accurate and current information when creating an account and keep it updated. Do not share your login credentials or allow others to use your account. You are responsible for all activities under your account. Use strong passwords and notify us immediately of any suspected unauthorized access. We may send you service-related communications by e-mail; you can opt out of promotional e-mails at any time.

Eligibility. You must be 18 years or older (or the legal age of majority in your jurisdiction) to create a guardian account. You may only onboard children for whom you are the parent or legal guardian, or for whom you have explicit authorization from the legal guardian.

8) Guardian Dashboard vs. Child App

Guardian Dashboard. The dashboard allows parents/legal guardians to view and manage settings relating to their children’s devices and accounts. The dashboard does not collect device data (e.g., call history, contacts, installed apps, precise location) from the guardian’s own device. We may collect guardian account details (e.g., name, email) and analytics necessary for security, support, and service improvement—see our Privacy Policy.

Child App. With appropriate consent and as configured by the guardian, the Child App may collect and transmit certain data from the child’s device (e.g., categories of websites/apps to block, usage metrics, installed apps list, location data where enabled, and alerts such as SOS/Pick-Me-Up). The exact data collected depends on your settings, your subscription, platform limitations, and applicable law. The Child App is accessed via login on the device where it is installed and is not available as a standalone web experience for the child.

You are responsible for obtaining and maintaining the necessary consents and notices for supervising a child’s device, and for configuring features in a way that complies with the law where you reside.

9) Lawful Use & User Conduct

  • violate any law or the rights (including privacy and intellectual-property rights) of others;
  • use the Services to stalk, harass, or track any person without proper consent and legal authority;
  • attempt to interfere with, disrupt, or damage the Services (e.g., malware, DDoS, scraping, spoofing, bypassing security or access controls);
  • upload or transmit unlawful, defamatory, hateful, obscene, or otherwise inappropriate content;
  • use the Services for unauthorized commercial purposes or advertisements;
  • impersonate any person or entity or misrepresent your affiliation;
  • collect or compile information from our sites/applications via automated means without our permission;
  • assist or enable others to do any of the above.

We may refuse, suspend, or terminate access where we reasonably believe a violation has occurred.

10) Minors & Consent

The Services are intended for use by adults (parents/legal guardians). Children may not create guardian accounts. Where required by law (e.g., under 13 or other age thresholds), you must provide the appropriate verifiable parental consent and any required notices before enabling data collection on a child’s device. You agree not to use the Services to supervise persons 18+ unless the law and that person’s explicit consent allow it in your jurisdiction.

11) Registration & Child Profiles

During setup you may be asked to provide information such as your name and email, and for each child profile: name or nickname, age or date of birth, and your relationship. Provide only accurate information and only for children you are legally authorized to supervise. By registering a child profile, you consent to our processing of that information as described in these Terms and our Privacy Policy.

12) Subscriptions, Billing & Trials

We may offer a free tier with limited features and paid plans with additional functionality and support. By subscribing, you authorize us (or our payment processors) to charge the fees displayed at checkout plus applicable taxes. If payment fails or is not timely, we may suspend or downgrade your account until the balance is settled.

Unless otherwise stated, subscriptions auto-renew for successive periods at the then-current rate until cancelled. You can view billing details in your account. If provided, free trials convert to paid plans unless you cancel before the trial ends. We are not responsible for failures to cancel on time.

Refunds. Unless required by law or by a specific store policy (e.g., Apple/Google), fees are non-refundable and remain valid through the current paid period after cancellation.

Promotions and coupons. Discounted plans may be ineligible for free trials or other promotions unless expressly stated at purchase.

13) Privacy, Cookies & App Disclosures

Your use of the Services is subject to our Privacy Policy, Cookies Policy, and any App Privacy disclosures applicable to your platform. These documents explain what we collect, why we collect it, and how you can exercise your rights under GDPR and other laws. Among other things, we employ technical and organizational measures to protect personal data; however, no system is 100% secure.

14) Intellectual Property; License to User Content

All trademarks, logos, trade names, service marks, software, code, designs, and other materials in the Services are owned by MSURFER OÜ or our licensors and are protected by law. You may not use our marks without our prior written permission.

If you submit or upload content (e.g., feedback, reviews, materials) you represent that you have the rights necessary to do so and grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such content for operating and improving the Services. Feedback may be used without restriction and without attribution.

15) Service Management; IP Blocking; Communications

We may remove or refuse content, restrict access, block IP addresses, or take other actions we deem appropriate to protect the Services and our users, including cooperating with lawful requests from authorities. By registering, you agree that we may send you in-app messages and e-mails about the Services and, where permitted, about MuslimSurfer offers. You can opt out of marketing communications at any time.

16) Third-Party Links & Stores

The Services may link to third-party sites or services. We do not control and are not responsible for them. Your use of third-party sites is at your own risk and subject to their terms and policies.

17) Representations & Warranties by You

You represent and warrant that: (a) you have the legal authority to accept these Terms; (b) you are the parent/legal guardian of each child profile you configure or have the guardian’s authorization; (c) you will use the Services only as permitted by law and these Terms; and (d) you will follow our instructions and documentation when installing and configuring the apps.

18) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICES DO NOT SUBSTITUTE PARENTAL OVERSIGHT OR PROFESSIONAL ADVICE AND ARE NOT GUARANTEED TO PREVENT ALL HARMFUL CONTENT OR BEHAVIOR. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

19) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MSURFER OÜ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain limitations; in that case those limitations apply only to the extent permitted by law.

20) Time Limit to Bring Claims

Any claim or cause of action arising out of or related to these Terms or the Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred, unless a longer period is required by applicable law.

21) Termination & Suspension

You may cancel your subscription or close your account at any time through your account settings or by contacting support. We may suspend or terminate your access immediately (with or without notice) if we reasonably believe you have violated these Terms or the law, or to protect the Services or users. Upon termination, your right to use the Services ceases and we may delete your data in accordance with our retention practices and the Privacy Policy. Paid subscriptions remain valid through the end of the current billing period and are otherwise non-refundable unless required by law.

Please allow up to 30 days for voluntary termination requests to be processed where applicable.

22) Customer Support

We provide support through our help channels. You agree to communicate respectfully with our team. Abusive, threatening, or discriminatory behavior may result in account restrictions or termination.

23) Compliance & Security

We implement technical and organizational measures designed to meet applicable EU and US security and privacy requirements, including GDPR where relevant. However, no online service can be guaranteed to be 100% secure. You transmit information at your own risk.

24) Miscellaneous

  • Entire Agreement. These Terms (including incorporated policies) constitute the entire agreement between you and MSURFER OÜ regarding the Services and supersede prior understandings.
  • Assignment. We may assign these Terms. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
  • Severability. If a provision is unlawful or unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in effect.
  • Waiver. Any waiver must be in writing; failure to enforce a provision is not a waiver.
  • Headings. Headings are for convenience only and have no legal effect.
